(Text) New Investment Law

 

Last Sunday, Sana’a issued Law No. (3) of 1446 AH regarding investment, including 101 articles distributed over 6 chapters and 15 sections.

The first chapter of the law included (the name, definitions, objectives and scope of its application), the second (guarantees, incentives and benefits), the third chapter included (the single window, registration procedures and investor obligations), the fourth chapter included (encouraging and protecting local production and developing exports), the fifth chapter (the General Investment Authority), and the sixth chapter (settlement of investment disputes and final provisions).

The last article of the law stipulated that it shall be effective from the date of its issuance and publication in the Official Gazette.

It is noteworthy that the House of Representatives approved in mid-December the final version of the draft law, which aims to organize, encourage and attract Yemeni and non-Yemeni capital to invest in the Republic of Yemen in the sectors subject to the provisions of this law within the framework of the state’s general policy and the state’s goals, priorities and directives in economic and social development, by creating an attractive and stimulating investment environment for investment in Yemen, and contributing to achieving a diversified and sustainable national economy.

The draft law focused on supporting small and micro-enterprises and community economy projects in addition to stimulating electricity generation projects, machinery and equipment manufacturing and various infrastructure projects, increasing local production rates and reducing the import bill, encouraging and stimulating investment in the manufacturing sector and transferring and localizing priority industries, especially industries related to the agricultural and fisheries sector, as well as supporting and encouraging agricultural, animal and fish production.
